(2) State i.e., the police or SHO or the investigating officer may not or cannot arrest you automatically without verification or duly weighing the evidences and also the documents pertaining to the facts and documents presented by wife and NRI husband

(3) So, it’s a big No, You Cannot Be Automatically Arrested On The Basis Of false Dowry alone as per Ministry of Home Affairs advisory

(4) THE ANSWER is No, You Cannot Be Automatically Arrested in false DV or On The Basis Of Dowry Charges 

(5) NRI wife went to the police station and filed a false complaint under Section 498A

(6) the main accused ie., NRI husband or his family members can be arrested

(7) and if this is indeed what happens then file a LTR against NRI wife for misusing the government machinery

(8) 498a nri passport may be fake but needs to be supported by documents

(9) proof required for dowry case filing women

Please note that:-

Indian Government has not started any men cell for NRI or man cell for NRI's, Non-Resident Indians/ Foreign Citizenship holder Indians/ PIO's or Non-Immigrant Worker (H1B Visa), but, if you are a man (or boy) whose wife (or girlfriend or neighbour lady or foreigner) has filed false FIR against you in India or abroad and you have unrebuttable evidences and documents proving her false FIR or police complaint {or her false court cases) then you need to put that girl/ lady/ wife behind the bars legally and technically using right judgments of Supreme Court.
